GroundUp Terms of Use

Welcome to GroundUp! These Terms of Use ("Terms") govern your access to and use of the GroundUp platform, available at https://www.groundup.cloud ("Service"), operated by GroundUp Systems Ltd, a company incorporated in the United Kingdom ("GroundUp", "we", "our", or "us").

By registering an account and accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility and Account Registration

To use the Service, you must register for an account. By registering, you confirm that:

  • You are at least 18 years old;
  • You have authority to bind any organization you represent;
  • All information provided is accurate and up-to-date.

We may suspend or terminate accounts at any time at our sole discretion, particularly in cases of misuse or breach of these Terms.

2. Your Data and Content Ownership

You retain full ownership of all data, files, geotechnical records, and other content you upload or generate using GroundUp ("User Content"). You may export, share, or use your outputs without restriction.

We do not claim ownership over your data and will not access it unless required for support, security, or legal compliance.

Upon account deletion, all personal data and uploaded content are permanently removed from our systems. We do not retain user data for any reason beyond what is legally required.

3. Use of the Platform

You agree not to use the Service:

  • To upload or distribute illegal, harmful, or infringing content;
  • To reverse engineer or interfere with the platform's security or functionality;
  • To share login credentials or circumvent user restrictions.

You are responsible for maintaining the confidentiality of your account and any activity under it.

4. Beta Disclaimer

GroundUp is currently in public beta. The Service may contain bugs, errors, or interruptions. We may modify or discontinue features at any time without notice.

By using the beta version, you acknowledge:

  • The Service is provided "as-is" without warranties;
  • You may experience unexpected behavior or data loss;
  • You use outputs at your own risk.

We welcome feedback to improve the platform. Any feedback or suggestions you provide may be used by us freely without compensation or obligation.

5. No Warranties

The Service is provided "as is" and "as available", without warranties of any kind. We do not guarantee that:

  • Outputs are accurate, complete, or suitable for professional decisions;
  • The Service will be uninterrupted, secure, or error-free.

You are solely responsible for how you use the information and results from the platform.

6. Limitation of Liability

To the fullest extent permitted by law:

  • GroundUp will not be liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the Service;
  • This includes, but is not limited to, errors in analysis, project delays, loss of data, or loss of profits.

Your use of the Service is at your own discretion and risk.

7. Third-Party Services

GroundUp uses third-party hosting, analytics, and infrastructure providers. While we choose reputable providers, we are not responsible for their performance, data practices, or outages.

8. Privacy and Data Handling

We respect your privacy. We do not sell or share personal information, and we will delete your personal and uploaded data upon account termination, subject to legal compliance obligations.

9. Termination

You may terminate your account at any time. We reserve the right to suspend or terminate accounts that violate these Terms or pose a security, legal, or operational risk.

Upon termination:

  • Access to the Service will be revoked;
  • All user data and personally identifiable information will be deleted;
  • We do not retain backups of terminated accounts.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. You agree to submit to the exclusive jurisdiction of the UK courts for any disputes arising out of or in connection with these Terms.

11. Changes to These Terms

We may update these Terms as we evolve the platform or move out of beta. We'll notify you of any material changes via email or platform notice. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
